§ 1 Scope and contracting party
These Terms and Conditions apply to all orders placed by consumers via the website www.diegartendusche.com.

A consumer within the meaning of these Terms is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
§ 2 Formation of contract
(1) The presentation of products on the website does not constitute a legally binding offer on our part, but rather a non-binding invitation to the customer to place an order.
(2) The customer may place an order either via the PayPal order button or informally by email to info@tarantik-egger.com. By placing an order, the customer submits a binding offer to conclude a purchase contract.
(3) The purchase contract is concluded once we accept the order by sending an order confirmation by email, or by shipping the ordered goods. In the case of payment via PayPal, the contract is concluded upon successful receipt of payment.
(4) We store the contract text and send the customer the order data along with these Terms by email after the contract is concluded.
§ 3 Prices and payment terms
(1) Prices stated on the website are final prices and include the applicable statutory VAT.
(2) Payment can be made via PayPal (credit card payment via the PayPal button is also possible), by bank transfer in advance after prior arrangement by email, or in cash upon personal pickup.

§ 4 Delivery, shipping and availability
(1) We ship worldwide. Unless stated otherwise on the website, we offer free shipping.
(2) Delivery time estimates on the website are non-binding indications. Further details are set out on the Payment & Shipping page.
(3) In all countries of the American continent, Fabryka Studios is the exclusive distributor of the shower; orders from these countries may be forwarded to, or fulfilled by, Fabryka Studios.
§ 5 Retention of title
The delivered goods remain our property until full payment of the purchase price has been received.
§ 6 Right of withdrawal
Consumers have a statutory right of withdrawal. Details, in particular the 14-day withdrawal period, the consequences of withdrawal, and the exception for bespoke, individually colored items, are described on the Returns & Refunds page, which forms part of these Terms.
§ 7 Warranty
(1) The statutory warranty for defects applies.
(2) Consumers are entitled to the statutory two-year warranty period from delivery of the goods for defects that already existed at the time of delivery.
(3) Please report any shipping damage or missing parts to info@tarantik-egger.com immediately so we can resolve the issue as quickly as possible.
§ 8 Liability
(1) We are liable without limitation for intent and gross negligence, as well as under the Product Liability Act.
(2) For slight negligence, we are only liable in the event of a breach of a material contractual obligation (cardinal obligation), the fulfillment of which is essential for the proper execution of the contract and on whose observance the customer may regularly rely. In this case, liability is limited to the foreseeable damage typical for this type of contract.
(3) The above limitations of liability do not apply to injury to life, body, or health.
§ 9 Dispute resolution
We are not willing or obligated to participate in dispute resolution proceedings before a consumer arbitration board.
§ 10 Final provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as it does not deprive them of the protection of mandatory consumer-protection provisions of the country in which the consumer has their habitual residence.
(2) Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
